2024.04.04 14:29 SkywalkerPadawan512 Hope is never lost. Story of a real estate legal battle which ended after 5 years today.

I'm a teenager and was even younger when all this happened, and not an expert on finance, so I will do my best to recount all this in the best way possible, and in a way that makes sense to me the most. Forgive me if there are any technical mistakes.
All this started 10 years ago, in 2014. My parents planned to buy a new home a little bit on the outskirts of Bangalore by a builder whose name I would not like to disclose (let's call the builder B1). Their project was promising, but still under construction. Therefore, the prices were also lesser, because the project was not ready. We were promised the flat by August 2019. My parents made a down payment of approximately 3 lac, and would sign to pay the rest by means of an EMI.
However, the project was massively delayed, as we learnt that construction was barely even started by mid 2019. By then, we had paid approximately 5 lac in EMIs. We waited until 2020 for assurance about the project. Then, the pandemic struck, and we lost all hope in the builder's empty promises. We sought a refund of our money, and stopped paying EMIs. These requests fell on deaf ears and we sent legal notices to the builder, but to no avail, which led to a consumer case filed by my parents against the bank as well as the builder in 2020.
Soon, due to the stoppage of EMI payments, the middleman bank (through which the EMI was arranged, let's call them MB) tried to use our Emergency cheques (any person who has dealt with this mode of home purchase probably knows what emergency cheques are), but we had emptied the associated account, which led to a cheque bounce, violating MB's policies. MB filed a case on us for failure of payment (under SARFAESI Act). This was filed in Gurugram, by MB bank, seeking arrest and detainment of the complainants, which would need my father's intervention, by first paying a lawyer in Gurugram, and then also arranging for bail. So we had already spent and would continue to spend on a lawyer in Bangalore, and then also had to incur costs for one in Gurugram. The bank also put us under mental turmoil and torture by constantly calling and threatening my father throughout the pandemic.
Now, our money was stuck, and the buyer's association tried to stick together, and battle this out. Now B1 declared bankruptcy, and through RERA, all assets and liabilities of B1 were transferred to new builder B2. We were still stuck. This was draining my family's finances and stalling all our plans (because the approx 8 lacs is a big sum for a family like mine)
Then the buyers' association started negotiating with B2, because many buyers wanted to bail out because of broken promises, and wanted back their money with interest. However, B2 was relentless, and were not willing to negotiate about refund, and wanted us to pay an even higher rate per sqft to buy the property, and then basically told us to do whatever the fuck we want to with the flat after buying it. We could however, keep the house for sale, so that other new buyers could take the flat off of those who wanted to bail out. So, many buyers, started paying off brokers (including my dad), to sell the house. Unfortunately not many flats were bought off of the old buyers for some reason, and the sword was left hanging above us.
While all this was happening, and after the pandemic was over, the consumer court still kept delaying our case, keeping our money stuck with the builder. To B2's credit, they were completing the construction fast, but we didn't want their flats because of their unreasonable demands and pricing.
At this point, our money was stuck with MB and B2, we were handling notices regarding two cases in different courts, broker was sucking money out of us, and the lawyer was also taking a fee for all this.
My dad's health was taking a turn for the worse because of all the stress and tension from this ordeal. He lost a lot of weight. My mom's health worsened.
Finally, after all these years (2019-2024) we got the judgement from the Bangalore consumer court. The order is as follows: The complaint is allowed in part. The opposite party No.6 (B2) is directed to refund the amount paid towards booking of Rs.3,31,940/-, EMI amount paid towards the Home Loan of the subject Flat in question of Rs.4,78,755/-, with interest @ 9% per annum from the date of respective payments till realization and further, damages at the rate of Rs.3 per sq.ft per month as per Clause-6.4 of the construction agreement for the delay caused till the date of cancellation made through E-mail dt. 23.11.2020 with interest at the rate of 9% per annum till realization to the complainant. In addition, opposite party No.6 (B2) is directed to pay the compensation of Rs.20,000/- towards mental agony and financial hardship and Rs.10,000/- towards the litigation cost to the complainant. In the circumstances, opposite party No.6 shall clear off all the outstanding dues under the loan Account No.HHLBAG00311670 with opposite party No. 3 to 5 (subsidiaries of MB) as per clause 2.10 of Agreement of Sale. Opposite party No.6 (B2) shall comply the order within 45 days. If opposite party fails to comply the above said amount of Rs.30,000/- carries interest @ 9% per annum from the date of order till realization. Supply free copy of this order to both the parties and return extra copies of the pleading and evidence to the parties. Applications pending, if any, stand disposed of in terms of the aforesaid judgment. (Dictated to the Stenographer, typed by her, the transcript corrected, revised and then pronounced in the open Commission on 30th day of March 2024)
I recently learnt that many builders torment innocent, hardworking middle-class people who just want to own a home in this manner. They do all this to torment people out of their hard-earned money, and confidently do this because they think there will be no repercussions because the buyers will just try to settle for anything they get/don't get. They are confident in continuing this harassment, because they think that people like us won't seek legal counsel. I am aware of the fact that many people can't afford legal discourse. But I think it is worth it to pursue such cheaters in court.
The cheque bounce case, as I am told, will probably be quashed by this judgement. However, my father might still have to travel to Gurugram, pay for his bail, and also pay a lawyer (although not sure about this).
To all those buyers who are suffering through this sort of ordeal, I wish the best for you and your family. Stay strong and power through.

2024.04.01 04:52 llavalle BMO - no "à la carte" chequing account? Am I missing something?

So I've been banking for a while with BMO. Had my main chequing account there for a while with the premium plan which was worth it even with the 5k required balance since it paid my World Elite Cashback. I have my mortgage with them and a 10k LoC I never used.
Fast forward to today. The Cashback isn't worth it anymore and it's not 6K to waive the fees. I now use an Aeroplan credit card (VISA Infinite Privilege) because I travel a lot for work so it's convenient to get priority boarding and status acceleration. Since it's not offered by BMO, I had the TD, then the CIBC and now back to TD (gotta milk those signup bonuses every 12mo). This means the MC isn't used at all anymore so I closed it last week.
Decided to switch my paycheck and mortgage payment to my WS CASH account and reduced my plan from the premium one to the "plus" plan which was an ordeal since I was sharing the Premium privileges with my SO's account and, unknowingly with her teenager (why not use the free student plan?!) and because of that I had to show up at the branch with them.
So anyway, I'd like to keep my BMO checking account for the occasional bank draft (vehicule purchases) and having quick access to an ATM. Having access to online banking is also very neat to track my mortgage and giving me the option to do lump sum payment (not that I would it's at 1.73% right now 😂).
So I went in and asked for the "no plans, I'll pay per transaction" deal and was told they don't offer this. When I mentioned that I would close my account and just walk across the street to Desjardins because they offer one I was told that I would loose access to my LoC (which I don't care) and the online banking platform to track my mortgage.
Is this BS? I don't want to leave 3K sitting there to get a "free" Plus plan. They offer the 12tx/mo "practical plan" but it's a fixed $4 a month - no way to get it waived unless you're part of specific groups (vets, above 65, etc).
Out of spite, I just opened up a TD chequing account and will use the $350 bonus to offset the lost interests on the minimum 4k... But was wondering if I was mislead about not offering a chequing account where you pay per transaction? Is this a trend? I just quickly looked at TD's offering for chequing account (for when I get the bonus) and they don't seem to offer it either...
Am I missing something?
EDIT : So the new month rolls over and they charged me $4 for the practical plan (expected), $5 for a overdraft protection I didn't even know I had but was free with the premium plan and $13 in excess transaction fees because apparently when you do a change of program, it's not pro-rated... it gets changed for the whole month and yup, WE had more than 12 transactions (cause my gf's account was linked to mine)... WTH.
Went to the branch to cancel the overdraft protection and try to contest the excess transactions fees. There were 2 people waiting in front of me but it still took over 30min to get to me. By that time I was so frustrated that I ended up just closing the account. This took WAYYYY too much time - 2 brand new employees who didn't know what to do with the $2 I just gave them to pay for the leftover fees... no one to help. What a disaster.

With the recent event showing how The Ring is involve in the shenanigans of the Wuthering Heights with their corridors and the mirror tech they use on the Dead rabbits. Not to mention that they bring up how Vergil doesn’t/can’t interfere with the golden bough retrieval. I believe that they are foreshadowing that Vergil will interfere will the story somehow. Consider his whole ordeals of losing his entire office, Garnet get stoned and Lapis becomes Charon all started with The Ring so he definitely has some beef with them. So may be he will help the sinners indirectly by fighting any Ring members in the basement under the pretense of personal vendetta and as such does not intervene with the mission. He’s definitely gonna face the consequences for this later on though
Idk, I just thought that the whole thing with Vergil and The Ring appearance all just to convenient for this not to happen.

2024.02.06 13:34 Maximus-otis Learnings from my purchase of a tenanted apartment

I purchased a tenanted apartment last year and here's my ongoing ordeal for prospective buyers to learn off.
Get yourself a cup of coffee before you set out reading as the post might be long one.
The apartment I purchased for self-consumption, was tenanted at the time of purchase with the tenancy contract valid for another 6 months. The had tenant verbally agreed to vacate the apartment upon end of ongoing lease agreement. Do not fall for any verbal/nonregistered email/WhatsApp/SMS confirmations/communications of any sorts, these are very speculative and subjective when it comes to taking things up legally and leaves a lot so scope for things to go against you)
However, once the ownership was transferred to me and I asked for the cheques to be exchanged, the tenant started asking for a new agreement on the pretext that the current agreement was in the name of the old landlord and would refuse to exchange the old cheques until a new contract was signed stating that he had called DLD several times and DLD advised getting a new contract. When I agreed to get a new contract done for the balance 6 months, the tenant insisted that the new contract had to be for 12 months because the EJARI cannot be renewed for less than a year (which BTW is not true). This would have granted the tenant an extended run of 6 months with no rental increase.
Finally I wrote to DLD and got clarifications on the e-mail that a new contract was not mandatory at this point and was only required after the existing contract (between old Landlord & tenant) was completed and only for the additional time which is falling short v/s the 12 moth eviction notice, and sent the tenant a registered e-mail (using Empost service) providing the written information from DLD and clearly stating that the rent for the apartment was overdue and that this e-mail was the start of the formal 30 days’ notice to pay the rent, failing which I would explore legal options. The cheques were handed over to me the very next day by the tenant, delivered at my doorstep.
I kept pushing my agent to resolve the mess for about a month which the agent couldn't and that was very frustrating because the agents know all these issues however stay mum to let the deal go through to get a commission out of the new landlord's misery. The ideal way would have been to get the tenant to sign a notarized tri-patriate agreement along with yourself & old landlord that the tenant would vacate at the end of the ongoing lease which would clear the uncertainty about whether the tenant would vacate on the lease end date or not. If the tenant signs the notarized agreement, then you are legally assured of getting the apartment vacated on the lease ending date or if the tenant doesn't sign the agreement, then you know the tenant has other intentions and you should stay away from such property*, unless you have the cushion to serve the tenant a 12 months eviction notice. Unfortunately, I only learnt this by virtue of experience. *
I lost about a month trying to convince the tenant (and probably myself that something better could be possible). Thereafter I sent out the 12-month eviction notice, starting my 12 month long wait. During this wait, I ensured that I send a rent increase notice to the tenant 3 months before the original agreement between old landlord and the tenant would expire, to ensure I dont have to bear the same lower rent from the previous contract. Also ensured to clearly mention that the tenancy contract would be renewed only for the months falling short of the 12-month eviction notice and the tenant needs to vacate in line with the eviction notice. Eventually the contract was renewed for the additional few months (and yes I was entitled for a rent increase in line with the RERA index).
Now I wait for the tenant to vacate the apartment on the end of the lease date & completion of the eviction notice period, so I can finally move in my legally owned home. Surely, amidst this ordeal, I ended up renewing my lease twice for a short term, trusting the word of my tenant, which proved to be a costly affair as I had to face a rent increase twice within the year, let alone the other admin charges, all of which could have been avoided had I insisted on the tri-patriate agreement to start with.
I hope to not have any other surprises, however I am also preparing myself for the eventuality where the tenant doesn't move out on completion of the eviction notice. Which then means the case goes to RDC for hearing followed by other procedures, during course of which I might end up losing more money and time. If anyone should have any clarity on the cost & time involved in the RDC eviction process, I'd appreciate your comments.

I know u guys have been waiting for Part Cuatro with bated breadth... But hey, I do have a life... in searching for a replacement for my stolen truck...
I had a beautiful beautiful ram 1500 outdoorsman truck, modified just right.. beautiful shiny crystal black paint, leather seating, quad cab, 6 inch.. i mean 6 feet bed length, bedliner, hard shell painted bed cover that you lift up instead of those rolled bed covers, tow package, and most importantly, beautifully lifted with a 4 inch lift kit and beautiful off road new tires and wheels..
I get random compliments from strangers for my truck a lot, from lots of short but sexy hispanic brothers, among other races of brothers and sisters.. some people comment like "such a tiny person, but such a big truck.."
I dropped off my truck for service at my usual repair shop for 3 years or so... and the next day, I got a call from police, telling me that there's a break in at the repair shop and my truck was stolen.. My immediate response was yelling "what the fuuck" for 5 minutes.. and having the cop on the other end of the phone telling me, "calm down, it's just property..." Then I learned that my truck was the only one stolen, and there's no security footage.. Then I thought, it gotta be an insider job..
You know if it's in china, they would have hundreds and thousands of security cams and I would've probably gotten my truck back.
Anyways, they have never found my truck again, and now I have settled with the repair shop's insurance company (that was a whole ordeal that I can write 15 multi-part posts on..), and have been hunting for a similar truck with no good result.. I started with the same criteria as my old truck, then I expanded to gmc, ford, etc, then I am like, okay, even if it's not lifted it's okay, i can mod it afterwards, but one thing I don't want to compromise is it has to be crystal black paint and quad cab.. and omg, trying to find a black quad cab these days is extremely hard.. everything is a crew cab, with bed size for about only 5 feet or so.. first of all, I have ladders and gardening rakes that are taller than 5 feet! how to fuck am I gonna store those in that short of a bed?! second of all, those trucks with shorter beds just look odd. They look like people with long upper body, but short legs.. Kinda like my body. I have longer upper body and shorter lower body.. And that is pure ugliness.
So the whole 3 day weekend, I have been dealing with looking for a truck, and actually dealing with ongoing drama with the french guy (a sneak peek into part 20 of this ongoing series...)
My best friend suggested that I probably shouldn't get another fancy truck otherwise it would probably get stolen again... And I am like, "then how can I compensate for my tiny penis".. And she replied: "Surgery".. lol. I love my best friend. There aren't a lot of good things in my life, but I definitely appreciate God has put her in my life.
btw, let me get a final rant about the status of trucks these days.. What is up with all the unnecessary accessories they keep cramming into trucks these days. I test drove some newer trucks, and they all have heated seats, remote start, moon roof, sun roof, a huge monitor screen, navigation, apple car play, android play, etc, etc etc.. oh, heated steering wheel!! HEATED STEERING WHEEL!!!! No wonder modern men are getting ever softer, you fuccking compare the jawline of men today to men from 1950s, 60s, you see so many men today with a weak jaw line and a lot of men I meet these days, I am like, if we get in bed together, should you be fuccking me or should I be fuccking you? Like how soft can you be to be needing HEATED STEERING WHEEL??!! You ass cannot heat the fuccking seat by itself??!! Give me a simple truck from the 1980s, and lifted it a little, and I am good to go. The only modern technology I like in my truck is the backup camera, and that's only because I have a really tiny slanted eye and only see 50%...
Anyways, there were some comments on my previous post about why I don't get plastic surgery to better myself.. well, there are some things even modern day plastic surgery can't change:
  1. the number of hair follicles on one's head. One big sign of femininity is a full head of luscious long hair. And they always say asian female hair is thick.. I am like, have they seen my fuccking hair?! My hair follicles are far and few in between, it's like I am permanently going through chemo.. my hair is thin, sparse and limp. I can never grow it long, because it would look even more sparse..
I remember when I was about 6, 7 year old, at the time, large plastic headbands were popular in china for young girls. I took my mom to a department store and picked out a really wide one. And the sales woman behind the counter said something like, you don't have enough hair for hold up that large of a band..
I also have a 6 finger forehead. Most people are already disgusted with their 5 finger forehead (a forehead large enough to fit the width of 5 fingers). Imagine having a 6-finger forehead! I went to my hairdresser one time with a taylor swift picture and asked for have similar bangs to cover my huge-ass forehead.. My gay-looking-but-actual-hetero hairdresser said gently to me: well, it would be hard because she has much more hair and her hairline starts lower on her forehead... Basically i don't even have enough hair for some proper bangs to cover my large forehead.
You say why don't u get hair transplant? you know what hair transplant is?! It would not magically increase the amount of hair on your head. It would just move the hair in the back to the hair in front.. I did go for a consultation, and guess what, yeah sure I can do a hair transplant, but my hair in the back is sparse looking already, so after moving some of it to the front, it would look even more sparse..
2) A midget height of 5'5 and longer upper body and short bow legs. How do u fix that? Sure, there are now surgeries for adults where they break your bones in your leg and give you an extra 2, 3 inches. But those look so painful, and now sure if I can exercise after that.. So not exactly a good fix for my short bow legs...
3) horrible eyes. You would think that would be an easy fix because double eyelid surgery is one of the most popular plastic surgeries. But you have not seen my eyes. First, my eyes are naturally protruding. If you google "TED eyes", you would see those protruding eyes due to thyroid problems.. But my eyes are naturally protruding on the top portion of eye. I actually consulted a doctor in Beverly hills that specializes in ORBITAL DECOMPRESSION surgery. You know what they do during that surgery? They shave down the bone and fat surrounding and at the back of your eye socket, so your eye balls can be set backward. The doctor said they can move my eyes back about 2cm.. The most common side effect is double vision.. I have also went to korea and consulted for those normal eyelid surgeries. Basically, the shape of my eye is really triangular and small both in length and width, double eyelid is NOT gonna give me much of an improvement. One more crease here and one more cut on the end are not gonna give me much improvement.
So you see, it's easy for people to say, oh, plastic surgery! Bitch, I am not dumb. Of course I've already thought about that.. But if plastic surgery can be the answer to everything, do you think Prince William would stay bald?!!
I rambled for 2 pages, and now finally onto Part 4.. where was I?
ah yes, on that sunday, he called and thanked me for the money, and told me that he would now go fix his bike, and meet me afterwards. Now a bit of context, until couple days ago when he started asking for money, the amount of his text has decreased dramatically, the warmth of the text was not there anymore. So I already kinda know that I was a dine and dash. After he called me that morning, I didn't see any messages afterwards keeping me updated. I started getting antsy, and thinking he's not coming to see me anymore. Yes, I am deeply insecure. My experiences haven't helped in that department.
I went to get professionally made up that afternoon, without knowing what time he's coming to see or whether he's coming to see me at all. By late afternoon, I just couldn't take it anymore. He was suppose to go DJ at night, so I am like, I knew it, he never intended to see me. Then I started calling him. At first he didn't pick up. Then he picked up, and saying that his bike is still being fixed, but he's at his friend's place discussing some business...
He sent me a picture of his bike being "fixed" late afternoon.. I am like, how the fuuck they gonna put it back by the end of the day. But he said that the owner of the repair shop is staying late to finish putting it back together

Then I lost it, I was like, I am leaving in the morning the next day, u never planned to see me. I just rambled on on wechat.. I asked him if he thought I was a slut for having sex with him so quickly... he replied with a voice note on wechat saying, "no babe, don't think like that"
When the night rolled around, I just kept calling him on wechat. He replied saying "stop calling, I am using my phone to DJ".. But he said he would come after his DJ gig.
so around midnight, he finally asked for my location, and said he's coming to see me..
He arrived in a totally tricked out sporty motorcycle.. The engine got upgraded, the color changed to yellow, the seats were longer? the exhaust pipes were larger? basically it went from a grandma motorscooter to a bike that would pick up chicks..
We first talked about his bike, I forgot what else we talked about. But to me, the most important thing we talked about was what exactly was I to him? I remember kept asking him if he likes me. He kept saying yes. He told me that currently, the school pays for his studio apartment, but in the future, he can find a real apartment so whenever I come to china, I can stay with him. He even mentioned, without any prompting, that he can meet my parents if I want? I was like, wo, wtf.
Some background: marriage is never something I am after. Great love affair is something I have been seeking in my whole life, but never found. I desire the great love between Heathcliff and Kathy from Wuthering Heights, or Jane and Rochester from Jane Eyre, or 金蛇郎君和温仪 love story..
We stood outside of my hotel, talked for an hour or so, and towards the end of our convo, I said: what if I stay an extra week? I was suggesting that I stay at his place, but he said that I can't stay at his place because 1) the school rents the place, and they don't like he has guests. People from the school picks him up in the morning so they would know he has guests... 2) it's too soon to be living together
So I said what if I stay at a hotel, and he come to visit me every day. He said he can do that. I said, okay let me think about whether I really want to do that. If I stay, I would be lying to my parents about where I am. So I said I would text you in the morning and let u know what I actually end up doing.
He got on his new sporty motor bike, getting ready to leave, and I asked, "do you like me?" for the 500th time that night, and he then raised his hands and pretended to choke me , and said yes, i like u. I chuckled and said bye and he rode into the night with my heart full of hormonal love...
Monday morning rolls around, the car that I reserved that was suppose to drive me to the airport arrived. I paid for about 500 RMB for that car. My parents waved me good bye thinking I was suppose to take a plane to go back to the states. Then I got into the car, and told the driver just drive me to the intercontinental hotel in the same town.. And he can keep the same 500 RMB. The driver didn't even flinch one eyelash, and just said okay. So after about 15 minute drive, I arrived at Intercontinental and checked in.
I texted me right after (that was in the morning) saying that I decided to stay, and I am staying at the intercontinental. No replies. I tried to be patient and do some work, but I was seething more and more inside, thinking I knew it, I am really just a dine and dash to him. Then around 4pm, when he supposedly should be off from school job, and still no messages, I texted, did you see my message? Then he replied saying he saw the message, he would go DJ at night, and would come after he finishes DJing..
Okay, I then wait patiently at my hotel room. While I was waiting, I thought I now finally know what those 后宫女人们 must felt back in the days. You know back in the days in imperialist china, we had kings. And each king would have lots and lots of wives. And most of the wives in the palaces barely see the king at all. The women are just very lonely and waiting to see if the king would grace them with his presence that night.. And while I was waiting for him in my hotel room, I felt like that...
Then midnight rolled around, i just started calling him.. The problem is that he never give me any updates, no texts telling me when he gets off work. I started calling, but no replies. Finally around 2, 3 am, I got a text message saying that he's very drunk, and his phone battery power is low... If he doesn't come tonight, don't worry, he would call me tomorrow morning...
I am like, you are a fuccking DJ, how do u spin the tracks while drunk?!
And he's like, the more I drink with the customers, the more money he makes..
And I am like how does that work??! But no replies after the last message..
And I cannot help but think that he's probably fuccking some other women.. I walked around my hotel room, got angrier and angrier, angry at myself for being so cheap, angry at myself for wanting to be with him with no good reason, angry at myself for lying to my parents, etc... And then I got a taxi and drove to his apartment complex. That was around 4am in the morning.
On my way there, I texted him "you told me once that I can drop by anytime ..."
When I got to his apartment door, it was locked from inside.. the chain was slided in the slit from the inside. I cannot see who's inside. I knocked on the door couple times, no reactions, no noise, nobody answered. I can reach the light switch by the door through the tiny opening, and i flipped that light switch several times, and no answer, no noise at all...
I then went back to the hotel, got even angrier.. I can just see him lying next to a woman in the same bed when I laid a week ago.. I got a shower, bought a plane ticket back to the states that day, reserved a car for the airport. Then it was about 6.30 am ish. I got a taxi and went to his place again, the door is still locked.
I knocked on the door, no replies. I called him on wechat, no replies. But he texted me, telling me that "don't stay here my boss is here to repair the door" "I already told you don't come here"
he kept texting me that his boss (a female) is inside the apartment, the boss comes here before they go to work together... I have to leave, because otherwise he would be in trouble because the boss doesn't like knowing that other girls know where he lives..
One weird thing was that even though I knocked on the door several times, the female boss never made a sound.. there's no sound coming out of his apartment...
I insisted on him coming out and talk to me.. and he finally came out to the hallway nearby the elevator, and basically said, didn't I tell you that they pick me up and drive me to school? He gave me some bullshit reason about the police sometimes check random paper works for expat teachers, and the manager just drive several expat teachers to work.. He insisted that they are not fuccking and neither are they a couple..
He said that he woke up seeing the door broke even more than before (I did kinda knocked it a bit too hard around 4am in the morning, and may have broke the chain from the wall a little...). So the manager called someone to come and fix the door. And they were just waiting for that repair worker. He said the manager is just playing on her phone, but looking at him weird with why someone is knocking on the door and he doesn't answer. He said he doesn't want the manager to know some girl know where he lives.. and I am like what's wrong with that.
I am like, well, put yourself in my shoes, and think about what naturally comes to your mind if you find out some guy is in my room.. one cute tidbit was right after I said "put yourself in my shoes", he immediately looked down to see my shoes..
But anyways, he got a text saying the repair man is here. The conversation ended with me apologizing to him for coming at 7am knocking on his door.. intruding on him.. and he's angry at me for doing that...
He then went down the elevator, gotten back to his apartment floor with the repair man.. I then watched him turn around the corner with the repair man. I then go down the elevator, left by myself, got back to the hotel room, called the private car transport to pick me up as early as he can, checked out the hotel, arrived at the airport, and don't know what I should do next.. How can I get him to forgive me and continue to talk to me.. That's for Part Cinq....

2023.06.22 22:18 explizito Got scammed when purchasing a vehicle, need advice on what I can write in my demand letter

In short, I got scammed a while ago when I bought a car, and recently the guy was caught. The car was in much worse condition than advertised, and he forged a bunch of documents about the cars condition. I have proof of all of this.
I already filed a court case, all I have left to do is serve him. However, going to court will take around two years because of the covid backlog.
I want to this guy to take the car and give me all my money back (plus everything I spent organizing this whole ordeal). From my understanding (and correct me if I'm wrong), if this goes to court, I can only sue for damages, and the court cant force the guy to take the car and give me all my money back. I can only get the difference between the value of the car and what it was sold to me for. Since I can afford another car anyway and the only reason I haven't already is space, if he defends I'll sell the crappy car he sold me as a scrap car for parts and buy a new car, and wait till the court case finishes to reclaim my losses. In the case where the judge will demand the return of the car and let me get all my money back, I plan to place the vehicle in storage and buy a different car altogether.
Here's the issue. I want to write a demand letter stating my claims (I know that a demand letter is usually for warning the defendant that you plan to sue, but I don't want this guy to try to avoid me if I give him a letter before I serve him, so I plan to serve him and give him the letter at the same time.). I kinda wanna have to avoid interacting with this guy any more than I have to. I was told to include your statement to the court in your demand letter, but my court statement and the demand letter have different demands (mainly the cost for storage being 0 dollars before the court case starts, and an unknown amount after).
Here's what my demand letter looks like so far. This is a very VERY rough draft of it, the idea is to focus on if what I'm asking for is valid and if I can get myself into any trouble legally.
"Dear [defendant]:
This is my final attempt and notice demanding the return of the money spent on [the car]. I am demanding $[cost of the car] CAD, plus $[court and document costs] CAD spent on court fees and documents, plus $[cost of losing a work day to sort this out] CAD for time taken off of work, plus $[cost of storage (currently 0 dollars)] CAD for the cost of the storage fees, for a total of $[total cost] CAD.
I have already filed a court case. I am attempting to resolve this out of court, but if we continue not to come to an agreement, I intend to move forward with a lawsuit and litigation.
Here is a statement of my case that I intend to submit to the court:
'[A statement of the events that occurred] I am claiming all $[cost of the car] CAD plus $[court and document costs] CAD spent on court fees and documents, plus plus $[cost of losing a work day to sort this out] CAD for time taken off of work. I am also claiming interest under the Courts of Justice Act.

DO NOT DO BUSINESS WITH ROGERS IF YOU CAN HELP IT.
In December, I reached out to Rogers to explore cheaper package options as my monthly bill was exceeding $200 for basic internet and cell service. However, I was dissatisfied with the options they offered. Consequently, I decided to switch to Bell and set up services with them.
Once Bell installed my services, I contacted Rogers to cancel my account. Unfortunately, the representative I spoke with at Rogers was being intentionally difficult to work with and employed tactics such as placing me on hold for long periods to frustrate me into hanging up. I spent nearly an hour just waiting on hold. Eventually, the representative reluctantly agreed to cancel my account and mentioned that return materials would be provided.
To my surprise, I never received the promised return materials from Rogers despite waiting for months. Even more frustrating, Rogers continued to charge me on a monthly basis. Realizing that the cancellation hadn't been properly processed, I contacted the call centre again to address the ongoing issue.
During my subsequent calls for support, I encountered a series of unhelpful individuals who seemed more interested in avoiding responsibility. Most of them tried to convince me that I could cancel my account again, but I did not qualify for a refund. Furthermore, they employed various tactics to frustrate and deter me. I was frequently transferred to different departments, some of which were closed or unrelated to my concern, resulting in disconnections. This cycle continued until I was eventually hung up on, which only further pissed me off.
I kept calling though, and fortunately, I connected with a representative who was genuinely willing to listen and investigate my call history. They discovered a note related to my original cancellation request and promptly provided me with a return label. This helpful individual explained the situation thoroughly, ensuring that all the relevant information was documented in the account notes. Remarkably, they even issued a refund for the months I had unknowingly continued to pay (although this may have violated company policy and potentially resulted in consequences for the representative who assisted me). They processed my request for cancellation a second time.
After returning the modem, which took about a week to process, I thought my ordeal was finally coming to an end. However, I soon began receiving persistent daily collection calls claiming that I owed nearly $1000 in missed payments.
I immediately contacted Rogers to rectify the situation and explained that I did not owe a thing. I clarified that the balance was a mistake caused by another employee who had issued a refund. Unfortunately, the collection calls persisted for about a week until one diligent employee delved into my account. They revealed that the refund had gone against company policy. According to them, the refunded amount should have only be returned after Rogers received the modem (which typically took 6-8 weeks after officially closing the account). The refund was intended to be issued by cheque at the end of this period.
Regrettably, the saga continued as I recently started receiving calls once again. This time, the calls were regarding a balance of approximately $500, covering the period between my second cancellation request and the present day.
The representative also mentioned that I should anticipate continued harassment until the outstanding amount is cleared. As the modem was received after my billing cycle had already completed, the balance will persist on my account until that time.
And to top this all off, due to Rogers' multiple mistakes throughout this ordeal, my credit score has now been negatively affected by two reports of missed payments.

Anybody ever had a celebrity encounter but not known until it was over?
I recently had these two memories come to mind and thought this might be a fun place to share them. The first one is just an all-around positive experience with a great guy, the second one.... well, I kinda embarassed myself a bit. Haha
I wish I had photos to go with these, but as you'll see I didn't know there was anything to get a photo of until it was too late.
The Good One: Years ago, I was working part-time for an event security company (this also figures into the next story) that sometimes helped out at local NHL games, but it's a small company so on pay day I had to drive to the boss' house to pick up my cheques. They lived in a really swanky part of town with big, fancy houses, but their road in particular didn't have the best maintenance - in fact there was a big pothole that, on this particular winter, got covered over with snow... and I happened to hit it, getting hopelessly stuck. I even went back to boss' house, where a couple coworkers were also picking their cheques up, and had them come out and try to push me out... but no luck.
At the time I was also running dirt broke so I knew I couldn't afford to hire a tow truck or anything, so when the boss and one coworker gave up and went back, leaving just me and this guy Richard there, trying to figure things out, I started having a borderline panic attack trying to figure out what to do.Then out comes this guy from one of the big houses nearby - he was tall, in good shape, very nicely dressed, and definitely a good looking guy, but nothing that really stood out as immediately memorable: like the sort of guy you might see anchoring local news or something, so nothing "clicked." He came out and made a remark about how he'd offer to help push but "probably shouldn't" (he didn't explain why, but Richard immediately brushed this off, saying something like "Oh no, don't do that, don't worry about it" (which I thought was just him being nice and conveying that we'd tried it and it wasn't going to work.)
The guy came over to me to ask if there was anything he could do, but I told him I couldn't think of anything, I was just trying to see if I could think of a way to afford a tow truck or something, cause otherwise I didn't know what I was going to do. He wished me good luck and went back inside.
Richard left, wishing my luck, and about 10 minutes later the guy came back out. "Tow truck's on the way," he said, and I started to tell him to cancel it cause I didn't have a way to afford it, but he put his hand up to stop me "No no, it's already coming. When he gets here, just send him over to my house and I'll take care of it." I tried to protest, and even offered to come back once I'd cashed the pay cheque and pay him back, but he wouldn't accept either, so I begrudgingly accepted his charity, introducing myself, and all he gave me was his first name, "Chris" (or rather, a different spelling there-of, but obviously that wasn't clear aurally.)
It wasn't until the next day when I got down to the arena for the game that I ran into Richard and he asked what happened with the car. I told him "That guy from the house paid for a tow truck." Richard seemed incredulous, "That guy? Don't you know who that was?" I didn't.
Turns out my benefactor was NHL player Kris Versteeg, and the reason he said he "probably shouldn't" help push was because he was out with a knee injury. I was VERY familiar with him as a player, but had never seen him out of uniform and without a helmet, so I didn't recognize him what-so-ever.
The Embarassing One: So, same job, this time I'm sent to a nearby casino's events hall to work a concert for the band Steel Panther - if you're not familiar, they basically play comedically dirty music in the style of 80s hair metal, complete with stage personas that wear big wigs and spandex and the whole nine yards. I was stoked, as I'm actually a pretty big fan of theirs.
Before show-time, I was standing by the door to the backstage, doing access control. There was a little table nearby where two people were chatting - a woman, and a pretty muscular looking dude with a shaved head and a bunch of tattoos, who I assumed was part of the road crew or something. I chatted with them for a couple minutes, and the conversation ended with me saying something like "I'm actually really stoked to be here. These guys are awesome."
The guy reached over, patted me on the shoulder as he walked past me into the backstage area, and went "Yeah man, THEY sure are." (emphasis on the 'they'). I spent a few seconds thinking about why he'd say it that way and then it dawned on me where I'd seen those tattoos before. The guy I took for a roadie was the drummer (stage name Stix Zadinia - if you don't get it at first, say it fast, haha).
It's amazing how different somebody looks when you're used to gigantic Motley Crue-esque hair and bright colored outfits, and then you see them with a shaved head in a tshirt and jeans. *face palm.*

Based on what I've heard, it seems the used car market is quite insane at the moment. Dealerships seem to have some options but starting at $15,000 which is a bit more than I'd like to pay ATM.

I set up a deal and arrived with plenty of time to spare. I purchased the fryer from a private listing, and it went extremely smoothly.

Talked about what we do and where we're from. After which they asked if I was interested in purchasing some downers (Fentanyl)... (Drugs).. (more potent than heroin). I wasn't interested. I've never seriously considered taking downers. but then proceeded to brag about how cool I am, and that I have actually tried hard drugs before, in the form of Methamphetamine.
She perked up at my mentioning this, and asked if she could get in the car.
So she's a drug dealer... but a pretty one. She hops in.
Quotes me some amounts and prices etc... I wasn't super interested in the drugs, maybe somewhat... I asked if she'd be able to stick around and 'partake', and her agreeing to this was the only reason I did it.
I already had the cash I needed. We drove to the address, I parked discreetly, and she left her phone in the car as she went to the house... She was in there for like an hour or so... I waited lol. Came out and she said they didn't have all of it, and we needed to go somewhere else. So we did... I don't know why I did.
This time I was waiting for like 2 hours until Eventually I saw a guy come out to walk past me. I handed him money, asked them to go fetch the blonde... They obliged.
Apparently he just announced the situation as he entered the house and embarrassed the girl, let's finally name her, Kas.
They came out and she got in the front and the guy got in the back lol... Wasn't expecting this...
She said she needs to go do a trade real quick, and directed me to another location to pick up some items. (likely stolen goods I understand now)... As Kas and I wait in the car for the guy, she tells me he sucks dick and I joke I should ask him for a bj. He gets in the car and Kas tells him I want a bj... lol I decline.
The guy apparently owed her money and was paying with merch... His merch was trash tho, and so they decided to get some new stuff. I was unaware of this at the time lol. I was literally only thinking about how she kept saying right after the next stop we can chill together. So they made me drive them to a store and boosted some stuff, I waited in the car, I was unaware of what they were doing until they got back and discussed how the alarm went off but Kas stayed to argue to distract, while the guy left. I was now an accessory to a robbery, and this was not going to be the last time these criminal strangers I decided to hangout with tonight, for cockheaded reasons, would put me into situations where I could have been arrested/charged with a potentially life-altering crime. I am embarrassed to point out that I wasn't just risking accessory to shoplifting, or whatever, but any crime involving my vehicle put us at risk of schedule 1 drug charges. Trafficking depending how much she has.
I'm just thinking about how sweet my hair looks in the rear-view. Damn. No wonder she wants to hangout with me.
After that, we went back to that second location so she could trade the goods.. or whatever. I really wasn't sure what she was doing or what it always took so long, just figured she was taking a downer and softlocking... But at this point I was in for a penny, already waited a long time. So another half hour or longer, the guy comes out, and he asks if I want a blowjob. Because she said I wanted one. lol I decline again. He tells me she's not actually a 'drug dealer', and she will always take forever wherever we go. She's not a good person, and prob won't come back out now.
I go knock on the door, because this time she said if she took too long I could do that. Someone on the other side asks who it is and I just say my name... Kas and an older woman open the door, Kas tells me she'll be right there... she promises lol. 15 mins later she's back in my car. Now she is noticeably more subdued. Basically, she trades stolen shit for drugs and then takes a hit of fet and konks down for a while. Didn't want to konk out with a stranger (mark) like me I spoze.
Now it's just us two. We find a spot and smoke some bitch (meth). I would later find out that even this first toke, she laced with some Fet... Earlier she had mentioned that if I'd never done downers before, she wouldn't even give it to me if I asked for it. Then she slips it to me...
We were supposed to go to her place now, but we went there (where she claimed her spot was) and she claims the lights in her apartment are on, sketching her out that it's her ex... lol ok. So we wander
We drive around and find some wifi and watch some stuff on her new phone, she seemed quite proud of. We walk around the nice buildings downtown. It was a nice time and, tbh it really messes with my head that we seemed to have almost greatish chemistry. I know... probably just seemed that way because of the mind-altering, right? Maybe. Or maybe I'm just a natural born sucker.
She chats up random people (fellow criminals) as we walk around, until she gets one to let us come up to chill... I wasn't really up for it, but had limited room for debate in front of the people I was not interested in interacting with. They weren't physically threatening. One of them had suffered a stroke. The other was bordering on elderly. The apartment looked like it belonged to Beetle Juice.
Why didn't I leave? Why did I put up with all this bs? The entire floor was covered in old clothes and garbage and various other unmentionable disease-ridden, maggot infested, piles of moist dampness, nested within a cloud of fruitflies that grows exponentially thicker the closer you get to the kitchen, where the walls and ceilings were covered in flies. If I wasn't high on both: meth (a drug I hadn't had in over 6 years). As well as Fentanyl, the most powerful and potent form of a type of drug I've never even tried before.
The first few fet hits... I was slipped. Had no idea I was doing it at all, let alone rather large fractions of each hit apparently. Kas mentioned it at one point and laughed. I wasn't sure it was that funny but I was okay, so I laughed.....
We smoke and talk and smoke on the cleanest (least vomit inducing) sections of the smallish "living room" (more like a fucking dying room). And it seems all is well. I'd rather be alone with Kas in a clean room, but she seems to be enjoying my company still I think... Getting to know her is the goal at this point anyway. The social pressure to conform was probably a lot, and I wasn't interested in resisting it.
She passes out. And very very slowly folded in half at the waist on the edge of the bed, so her face was basically between her ankles. I stopped her half way the first time and gently pressed her shoulders, hoping to have her laying on the bed in a more natural way. She woke up, confused, and angry. So I'm not touching her like that again, even though I was trying to help. The others laugh and said not to help her, she just does that...
So she was folded like that for a while, while the handicapped one tries to convince me to deposit some cheques for him and he'll pay me extra, because some excuse I can't even remember like he doesn't have a bank right now. I donno. I was mega-super-high at this point. My head was completely spinning from the fet, and my inhibitions were non-existent from the meth. One million confidence. "I don't even need to look at those cheques, I'm in!". We leave the old man, asleep on a chair, and Kas, still folded over awkwardly passed out. I grab the scraps of tinfoil she's left around her "supposedly my drugs", before we leave.
We proceed to drive around... Looking for a pen, so he can "cosign" the "cheques". Ended up picking up Ken, a real asshole with a heart of gold. Before I entered a gas station and asked to borrow one. After going through MacDonald drive through, to ask for a pen...
We arrive at my bank, which had a message on the ATM, "no envelopes, no folded paper" so it saved me from the scam here. I was like "no can't do it here." Even though Dampy was still trying to get me to do it. We then proceed on the most pointless fucking journey of all time, driving from bank to bank at 3:30 am, looking for an ATM that we can put the checks into.
Honestly I can't even believe how stupid this is. I have mentioned many embarrassing moments, and will many more, but this one is just so fucking simple and basic and stupid. There is no way this scam should have worked on me. I did drive a "hard bargain" I guess, and only gave him 100 for what he claimed was worth like 300. I did withdraw 250 tho, just in case... but also he literally hit the buttons on my bank machine. I have to keep blaming the drugs for me not reacting appropriately. There is no way I would have done any of this otherwise...
The banks must have caught onto this scam, because they all prevented me from doing it in some way. Until I just agreed to loan him the hundred and I can deposit them later. At this point, it was actually mostly to get them to stop insisting, so we can go back and check on Kas, who was left alone for way too long at this point. An hour or more.
We arrive back and as we enter the apartment, Kas is right up in our grills! All of the fet and meth is gone, and so is her new phone. She literally got it that day apparently and didn't even get to recharge it once, and never put the sim in. She was blaming me, and blaming Dampy, but the old man who we left here, who was gone, was not a suspect apparently..
She was flying off the handle. Absolutely off the chain. Until I produce, for her, the foil I saved, which seemed to quell her suspicion of me entirely. So she was really going hard on Dampy about the phone being missing now. Which nobody seemed to know for sure if it was in the apartment, or the car. Not even Kas. But she was straight up attacking poor Dampy at this point. Goin' nuts. Pissed about her phone, but also saying she was pissed about him scamming me, which she called out right away when I told her where we went lmao. She said I was a nice guy, and that she had vouched for Dampy, to me, so that I would enter to begin with. So that pissed her off more than the phone, seemingly..
She was also just generally pissed about being left alone like that in such a position, of course. Apparently the older guy didn't lock the door when he left her there.
A lot of yelling and arguing ensued, for a long time. Around in circles we went, with dampy in the middle, admitting he scammed me and apologizing to my face in one breath, only to turn to Kas in the next to claim he didn't do anything wrong at all, and there's nothing to apologize for.
Some hours, puffs, and a lot of searching around this disgusting place for a phone that I know isn't there later. After sun-rise we are leaving that hell-hole, and apparently driving Dampy someplace far away... Kas is basically in battle commander mode at this moment (if your commander was assaulting you all the time, and your name is Dampy), and she is just telling us what to do basically. So we get in the car and drive while they literally physically fight as more circular arguments for a long time. With cycles of denial, repent, regret, and then denial again...
Why are we still driving? We left town a long time ago. Kas isn't telling us where we are going, and just gives one direction at a time. She's become less animated, but now insists that when we arrive at our destination, Dampy is going to be deaded. (claims she buried a weapon)... I literally don't believe her, and continue driving. Unsure why, or what the point is? Beyond maybe kind of scaring Dampy into an even more submissive form?
We come to a small town where we are directed to a small train-yard-type place. She tells me to just search the car for the phone, while she walks down the tracks with Dampy. Now, I never believed she was going to kill him, and neither did he. Because he had many opportunities to just get out of the car and flag someone down or something. But I was pretty sure if scaring the guy a little was the real true purpose of this journey. (likely a swap point for something illicit, but not certain.)
I later learn that she was questioning him about the series of events from the night before as they walked, but never learned what else they did if anything. He apparently told her I suggested she ripped me off. Which she did do, but I still didn't suggest it in such a way. These people have a way of twisting the truth... As well as telling accusatory lies with no evidence, while ignoring anything counter.
They came back to the car, and argued some more, then we left. By this point I was quite parched indeed. But we still had a long drive from wherever this is to where we came from.
Stopped at a Tim Horton's. Ordered 2 donuts and some chocolate thing with whip cream on top. They give us 1 donut and extra whip drink thing. 7.50. We say that we asked for 2 donuts, not extra whip. The East Indian gentleman behind the counter simply denies that's what we ordered, and refuses to hand over the other donut. Literally insisting the order is good, and to drive on. My guess for their motivation; If they gave us the donut, they would have to give us the extra whip for free because we didn't ask for it, or make an entirely new beverage, just to give us a little less whip... (which it looks basically the same wither way)
Kas was yelling, I was pointing out how they are wasting time and money with the drive-thru line up by simply not giving us like a 20 cent discount on the second donut, and letting it go. A white lady finally came and grabbed the donuts, and yelled at me to never come back to Timmies again. Which I would never go unless someone else asked me to go... And there are like 8 timmies in every town so who cares lol... Karen? Or maybe totally reasonable response to several loud and ignant "methheads".
I think we went back to the gross aptmnt to look for the phone some more? Dampy hit some Fet and turned retarded. Kas decided it'd be fun to dye her hair. The bathroom needed to be cleaned first though, and Dampy was too stoned to help, so we left. Another ordeal happens where we have to go back up for cigs and I barely make it back in the door. She yells at me from the ground where they are at. They aren't there, but I find them and throw them down. She seemed quite pleased. And impressed with my speedy door catching skills. Then we went to the park, and she used the bathroom there to dye her hair. I had to help do the back and top. It was really sort of intimate. She said it felt really nice.. and kept falling asleep. If we weren't still high and tired af, it would have been a better bonding moment.
After that we went to Harveys to grab some flurries, and so she could finish her dying procedure in their bathroom. She was in there a long time, so I decided to kick the door, to wake her up in case she fell asleep standing up again. She didn't like that at all. lol. Was definitely a misjudgement on my part. Way too loud. She def doesn't like being spooked, gets her mad...
She seemed to get over it. And I decided to see if she wanted to go to my place out of town with me, surprisingly she seemed pretty interested in going. She just said we need to go get some clothes in case we stay more than a day. We pick up some guy on the way, and he is nice and talkative. No idea if he is the one that stole my wallet or not, but maybe? At this point I don't think I noticed it missing. Anyway, on our way to where we were gonna drop him off, we stopped so she could do whatever it is she does for way longer than necessary. It is blatantly disrespectful af to make people wait so long. In for a penny though... I donno. I just kept on thinking of how nice it would be to sit in a clean quiet place with her to actually interact meaningfully, after we both got some much needed rest... I think, maybe this was very delusional thinking..
She took so long the talkative one left to walk it on his own. A while later she comes back, and tells me she heard her "X" (still not sure how on or off they were) overdosed the night before, behind a local church. At the time I didn't question this at all. It was obvious that she wasn't processing this news yet. It seemed to drag down the mood, and she became blunt and rude, and while she was always bossy, which I don't mind tbh... she became straight up demanding and commanding while being rude as hell for it. I think she was trying to control it, but this was the beginning of the end. And at the time I was thinking I should definitely cancel the trip to my place so she can deal with this... I tried to, but if she actually was excited to go this might depress her even more? Make her feel ditched... by a guy who was like a loyal dog at that. So I decided it had to be her decision... Was the wrong call for sure.
It does seem like a major coincidence that this happened the same night I met Kas. Retrospectively I've begun wondering if I should have been questioning a lot more things I was initially taking at face value: Why does it take her so long every time, while she has friends all around, and often in the car with me. Almost like they were seeing if I fell asleep to take my personal items and cargo... Or maybe even waiting for an opportunity to get their hands on my car? Or like the fight between her and dampy, whether that was staged so I would like gain more trust for Kas and she could manipulate me even easier?... Where did we actually drive earlier, and where did they walk to?... Were they in all of this together? Did they stage this whole phone drama for some 4D chess maneuver on me? Did they slip me the Fet earlier in an attempt to knock me out? Or make me stupid and confused? Should I be more angry about it than I am? (I think there is some credence to my hypothesis that they wanted to get in the car when I wasn't there, or alert, because when I told Kas I needed to use the bathroom shortly after we met, I suggested I could just walk instead of driving, and for some reason she seemed to think that was a great idea...
We went to another location involving a lot of insulting of me and my driving, coming from Kas, who cannot drive, yet becomes the biggest backseat driver of all time when they are coming down, or in a mood, or whatever has got her animated... This location was pointless, nobody came, but she did change clothes in the back seat. I didn't look. Probably would have gotten a punch to the eye.
Then we went back to a place in the middle of town, the place where I first saw her, and probably one of the least discreet locations yet. I don't know why I wasn't asking where all the dope I bought was.. or noticing my wallet was likely already gone.. Or why I can't just go in with her this time.. She was moody I guess and every time I asked a question, I had to choose wisely, because she will snap every time, and she will only answer so many... I am cutting her a tremendous amount of slack because of what she told me earlier. I am having many second thoughts, as she reaches for my charging phone at 4% and asks if she can use it to send a text. I donno why I didn't stop her from walking away with it. At this moment though, I really didn't have any doubts if I could trust her. I trusted her 100% at this point probably...
She said she would literally be 10 mins this time. Reassured me again and again. But 2... maybe 3 hours rolled by, and I began to wonder if I had made some mistakes... When she finally appeared, but she wasn't alone of course...
She arrived with her sister in law apparently, and some guy came over very indiscreetly to join them. They walked from the side of my car around the the back of the closed store I was parked in front of. No idea what they were doing or talking about. I just wanted to go, my patience was so close to gone..
I am looking for my wallet in the car, I look up and there is a fucking police squad car, parked DIRECTLY in-front of mine so I cannot leave. I look around and they are asking for the guy who came over, uninvited... The cop literally saw him, and he has a warrant. There was a mini-struggle, resulting in the perp being slammed front-first onto the hood of my car. Exactly like you would see in a movie-picture show. It was completely insane. I was just sitting here for hours, dying and going insane, then all of a sudden I am trapped by cops while a dude is being booked on top of my hood! (Good thing I drive a 90s era volvo. The hood is SOLID, and the dude got hurt bad, not my car)
When the guy had his drugs taken and was put in the squad car. The cop came to talk to the rest of us... the other girl outside the passenger, Kas in the passenger, and me in the driver seat. The moment I looked up and saw the cop was scary, the moment another cop pulled up was equally intimidating, and then the moment a random dog-walker came out from behind the squad car on the side-walk and I thought it was a drug sniffer for a split-second where my heart was pounding out of my asshole.. but the moment the cop tried to claim that where that criminal dude came from was out of my vehicle's back-door, which would give them immediate cause to search, I was in absolute fight or flight mode.. I have no idea how many drugs are in me or the car at this point, or where tf they are. If they choose to believe he came from this car, it's over. I lose my car, I will be charged with something substantial because of the type of drugs. But the cop was actually easily convinced he was never in the car. The store's security camera might have backed us up, which we mentioned...
They had to run us for warrants, and I asked if they wanted my license, they said no and just asked for my name. Which I then realized was extremely lucky, because now I realize my wallet is straight up missing... No more warrants on anybody, we are cleared to go. Before we leave the other girl literally throws drugs into the car to Kas... Every time Kas has tried to let someone in the car I don't argue, but this time she could see on my face, I was probably more angry than her, so we didn't let the other girl in the backseat as I floored it to do a 180 onto the street as soon as the cops left.
I didn't realize my adrenaline was still pumping, and I was pissed, and afraid, but relived. Kas was less than impressed with my attitude, driving, and general behavior at this point. We were both coming down most likely, I was out of patience, waiting, before the cops arrived, and that really pushed my patience beyond the brink I guess. Because when the cops were there, Kas was yelling at them, and I told her to shut up. Which was not as mean as many things she said to me, but the way I said it and the timing, and the fact she was just trying to help me with what she was saying (The way she was yelling, I don't think was helping, but still, she was trying...)
So given that situation forcing me to make an ass out of myself, I felt very awkward for the rest of the day. I prob should have tried taking another hit and just relaxing at this point. Maybe go our separate ways... if only for now who knows. But whenever I thought about dropping her off, I'd think about how I'd never find her again now that both our cellphones are mia... I believed I could still turn this around, despite the negative atmosphere forming around us. Besides... She has my cellphone, right? I asked her for it several times and she just gets angry. I noticed she got a tablet and shitty broken phone when she was gone... and now my phone is gone. She was telling me that she was trying to get it back... I believed her, and I believed that she must have lost it accidentally or past out and it was stolen.
But now I believe it is more likely that she started off with me as just another ignorant and stupid mark that she can drug and scam on with her criminal friends. But I was slowly winning her over with my crystal charm, (Meth gives a lotta confidence... if I had this level of confidence in my social skills my whole life, I'd be unstoppable.) During most of the second day she seemed to be genuinely enjoying the time spent with me. After I rescued her smokes earlier she seemed open to the idea that I wasn't useless after all... But, (unbeknownst to me at the time) whenever I made her mad, she would likely end up using it as justification for taking something of mine. She earned my trust to be around my stuff relatively unguarded... I honestly don't know when I lost the wallet. If I wasn't high and stuff it wouldn't have happened. But it's like... Why take the whole fucking wallet? Why not just take the cash? Everything else is of no value to anyone else, right? Just have some mercy, jeez...
So now I am apparently waiting for her to hear back from someone at that other place, so I can get my phone back? But we are across town using free wifi... Everytime I ask her anything it's futile except for making her lash out...
At this point I am in a negative headspace, and spiraling in cycles of depression and doubt in all things. I am unable to be funny or positive or entertaining at this point, and it is an uphill battle on a doomed mission.
I am trapped here without my wallet or phone, and the one person I am relying on to get at least one of them back, seems to either have already turned on me, or is doing so rapidly... A part of me believes she was playing me every single second. There was no way she would go with me to my village lol, she just wanted to keep me wrapped around her finger in the city until I was wrung dry by her and the minions...
But looking back, there seemed to be at least a few hours where I was on the trajectory I so desperately desired, and had been imagining since I saw her... I was actually going to be heading back with the girl who I had no control over my saying something to. I just had to... it seemed almost like some kind of fate, I donno.
I know people say it's weird to look at complete strangers like that, but the women who read romance novels seem to like it... I just think a combination of nature and nurture causes men to choose a partner in different ways from one another... Some men do sort of "imprint" on women, and for me it's not dangerous for anybody but me apparently. I've always had a problem with women where I don't feel anything for months, sometimes years, and don't feel confident or motivated enough to really "try" either. Unfortunately for me, when I (for lack of better term) "imprint" on an individual, it can be difficult for me to act normal and casual and fun. I find it difficult to be myself, and to focus, because so much of my concentration is centered on holding back the tsunami of hormones and territorial emotion I've had locked up for who knows how long.
I've pretty much come to terms with the fact that this is exactly what stalkers are made of. People who imprint as easily as me, but become more obsessed, and don't even try to temper it from becoming an unhealthy obsession, are more likely to do harm in the form of all that stalkerish behavior pushed to the extremes...
We drive around, we park, we find wifi, repeat... I think she was just trying to score more drugs for her... But at the time I believed we were waiting to get the phone, so when I'd notice she had knodded off, I kept waking her up, and she was getting right pissed about it.
She left the car, and encouraged me to come with, despite we have been sitting in relative silence, only broken by my asking about the situation followed by an annoyed Kas basically telling me to shut up and/or insulting me... (looking back, not sure if she even had a motivation for me to stay besides the car itself... considering they already took all my money, and drugs...)
So I donno, it's possible she felt bad about that and was legit trying to get it back... Or maybe she just liked having the ride? But she knew I wanted to go back to my ol sickly cat, and refused to update me at all on my phone. (At this point she could have told me she wasn't getting it back tonight so I could just go now... Instead I stick around until I run completely out of patience as we accomplish nothing that will help my situation.
A man behind us taking cigarettes out of a street ashtray... She asks what he's doing, I tell her while chuckling because it's kind of gross and funny. She asks where they went. I say I donno. And she just snaps! I am a useless moron for not knowing where he went? I didn't realize she was being genuinely paranoid this whole time. I did see the direction he went in, I just didn't see where he ultimately ended up, because it was dark. I tell her don't worry because I did see him go to the right, down the sidewalk. She doesn't listen and demands I start the car and go right now, followed by insults. (They can sting quite a bit... This person was defending me multiple times earlier today and vouching for me to her criminals... Now I am a worthless slug I guess?)
I refused to go, because my patience was getting thinner and I felt like it was best we try to hash it out calmly if possible. My intention was to deescalate. She threatened to leave if I didn't start the car and leave right this second. I took the keys out of the ignition and turned to her to try and look her in the eyes to talk. If she was so uninterested in hanging out now, or helping me, that a single disobeyed order was enough to have her walk away now? I knew I was totally screwed. I knew talking to her wasn't helping, but I was still in a bad state of mind, and tired af, and I just kept pushing it. I couldn't let it go and leave it be.
So we are arguing badly while driving now. Probably over my phone and the fact I am going to have to abandon it, and prob never see Kas again, not that it seemed like she cared, and not that I ever should have... Let alone still. She tells me to pull over and let her out in motel parking lot. She gets out, and I am prepared to let her go. But when I see her fading into the darkness I feel myself moving to follow her. I had to just try one last time, because I needed her to know that I care. As sad as that is. That I understood she was going through a lot, and that I was not being patient enough as well. But whenever I opened my mouth to speak she would as well, and spit out like 2 separate and irrelevant complaints against me for every word I uttered. Just drowning out my words, and thoughts completely. I was totally flustered. She was sitting on the steps to an old building, and I was across the street slowly getting closer. She told me to stop approaching and some other stuff I forget. All I managed the focus to muster before I walked away was "I'm just afraid that I'm never going to see you again." And went back to my car to leave... As I rounded the corner I heard her say "just give me a minute alone and maybe I'll come back to your car." And I sort of wished I hadn't heard that, so I would have just left...
Instead that's all I was thinking about, how my words and emotion seemed to actually sway her. Then I thought about how long I might be waiting here, and how I might do that only to discover she took off anyway. Just to treat me like her bitch one last time. So instead I drove the car around the block to park in front of her... and she was pissed... I went to drive away, but then remembered her saying she felt like killing herself not long before this, as a part of one of our arguments, where she uses her "current situation" as a license to treat me like I am less than human waste. (still pending on how true her tragic loss is, but I think it's real. I will check the obits moving forward... but seemed real.)
At this point I am trying to get out the stuff I wanted to say earlier, with similar levels of no success. She made fun of me for saying I wanted to kiss her after the cop incident, where I was losing my shit, and said somethings really dumb. She said she would never kiss me, and was never interested. I am just a womanizer, trying to take her out of town while just expecting to get laid... (I would never go through this much just to get laid. I would at least always want to try out a "normal relationship" with the girl I'm interested in at the time.) It's true I did have some sexual thoughts about her from time to time, and wanted to turn around when she was changing, I am only human after all. But I always treated her with complete respect in that way. (Plus, Kas literally fell asleep right beside me like dozens of times, I never made a move or did anything untoward in any way. She said I was moving too fast and coming on too strong. Which was all true. I only knew her a day and a half at this point, and I'd said some really non-smooth things at points. If I wasn't on drugs I'm not normally on I wouldn't have embarrassed myself in such cringe ways.. I'm sure... but she also accused me of messing with her head and trying to make her care. I don't know if I messed with her head, but I did really want her to feel the same way I did of course... And her telling this to me at least hints toward the possibility that maybe, just maybe, I was more than a complete mark to her, if only briefly... that would be incredibly validating. (next to the alternative possibility, where I am nothing but a stupid ignorant naive mark she took to the cleaners, where her and all her friends are just laughing at me behind my back during the entire wash of an adventure.)
We argued too many things to recall. We shouted. She gets pissed and says "you know I will have no problem putting a few holes in you right now" as she decided to approach. I took a half step back and angled my body, which she then stopped approaching... I told her I was going to give her the phone anyway, so she could keep it, but I had to ask about where all the drugs are I gave her money for. And in response she got very upset... threw the crap phone she likely traded for mine on the sidewalk and said you can have this phone. Then she walked away, as I was out of words, and ideas, and just yelled something along the lines of "kas" "pleas" "talk" "kaas". (I am pretty sure I heard her say that is not her name. Which I cannot think of a more depressing thought than I actually never even knew her real name, and I actually thought this girl liked me and trusted me and stuff. Truly pathetic)
I lost my wallet, with health card, license, debit with tap, and at least like 150 bucks in cash... probably more.
I lost my phone, which I literally just got like a week ago. I've never lost a phone before in my life.
I gave Kas $90 initially for the first score. Had 100 bucks taken off me by Dampy. another 80 by kas.. I bought her food a few times. I spend half a tank of gas which is like $50... Overall, I lost like $600 and got nothing out of it except this hangover and the weirdest and wildest contained adventures I might have ever had on my own. Like going into it without friends. Just only meeting new people. New and wonderful people...
I hope this isn't the end.

This is kinda long so there will be a tl;dr at the bottom
Some back story before I get to the point:
I run an advertising business. A recent job I got needed me to give them a large quantity of a certain item. So I ordered them from a supplier. I paid about half the total amount (I paid 8.5k, the total was 19k if im remembering right) weeks before I was supposed to receive the items.
A few days ago, they delivered the products. Now, I had already asked them about what payment method I'd use to pay them once I receive the item. They said cash or cheque, with cash being preferred.
On the day of the delivery, I noticed I didn't have the amount I owed in cash, so I offered to pay by cheque. The delivery man (the assaulter) said he was told not to accept cheque. I called the salesman I've been speaking to and dealing with this entire time, and he said they can not accept cheque.
There was a whole ordeal about this, where they said they'd accept it, then said they wouldn't. Regardless, I later ended up writing a cheque, the delivery guy signed the payment forum, and then accepted the cheque. After that, he came back and went: " can't accept the cheque."
It was getting close to iftar and I was planning on leaving the office, so I just told to guy to come back tomorrow to finish up, as I was fasting and tired. The guy refused to leave my office and was very verbally aggressive. He kept saying he has to take back the product, and I said if he wanted the product back, he had to give me my cheque back, otherwise I'd end up paying them in full without receiving what I was supposed to. He refused.
We got into an argument, and then as I was leaving, he said he plans on staying in the office. Ofcourse we can't allow that because we have a bunch of expensive equipment as well as government documents (we did work for the GCAA a few days/weeks ago and we have documents related to them and other confidential information).
Ofcourse, as this was my private property, I physically tried to get him to leave (I spent a good while trying to verbally convince him to get out the office and wait outside if need be but he wouldn't listen) where I grabbed his hand and tried to get him to exist my office.
Now this is where the assault bit took place. The moment I grabbed his hand and pulled on it (I wasn't aggressive or anything) he grabbed me by the throat and pinned me down. I couldn't breath. He was strangling me. I know the salesman guy (not too sure on his actual occupation) I said I was dealing with was the one that told the delivery guy(s) to not leave my office, and may have also been the one to tell him to get physical with me. Being tired from fasting and working all day, and being much weaker than he is physically (I am 47 years old, I have an angioplasty from a heart attack I had a year or 2 ago and a very weak back) I grabbed the closest object to me (a hammer) and hit him with it (I genuinely believed my life was in danger).
I made sure he wasn't hit anywhere that would cause any significant damage, so I hit him (not even close to full force) on the ass cheeks and other muscle heavy parts.
As for the damages I sustained, as mentioned, I got choked until I (felt like) almost passed out, I got bitten on the thigh (it broke skin and I had to get 2 tetanus shots) and I was also punched in the face.
Now, after all this transpired, I obviously went to the police station and filed a report. Turns out, they also filed a report against me, claiming I hit them first (makes no sense. As I mentioned, I am much older and weaker than the individual that they claim I hit. Besides I had no logical reasoning to hit him first anyway). The police got all my statements as well as my medical report showing I was choked, bitten and scuffed all over.
Tl;Dr: Got choked, bitten and punched by a guy that refused to leave my office because he didn't like the payment method even though it was already pre determined.
So my question is: am I protected under the self defence law, and do I need a lawyer, or can I represent myself in court? Because they police did confirm this will go to court. How much should I expect to spend on a lawyer? What if I'm unable to afford a lawyer? If I were to win the case, could I sue them? I'll clarify this, but the assaulter is the driver, so presumably he doesnt have much money to pay me if I do win, could I maybe sue the company instead? Any and all help and opinions would be greatly appreciated. Thank you.

*(EMAIL CONVO BTWN MYSELF AND FORMER EMPLOYER WILL BEGIN BELOW)*
I do not know much about worker rights as they pertained to my specific situation: I was on a Dr. approved medical leave for my health. The only information I was able to find stated that a person on a medical leave has the same rights as someone on a maternity leave. I did call my local labour office as well as the Ontario Tribunal office for human rights (Can't remember their exact name), and was only passed around to different departments, was told I would receive a call back, and never heard from either at all. So now I am asking here:
Were my rights in fact infringed upon?
Is there any recommended course of action I can take?

Additional Information:
-I was a senior, longstanding employee of this organization, working my way up through various roles over the course of several years
-I was very open about my poor mental health and had communicated far more than I knew I needed to to the Director and my Manager before I went on my leave. Director knew the severity of my condition
-Manager went on maternity leave shortly after I started my leave. TEMP MANAGER was hired to fill in for her temporarily
-On ALL emails, I included the Director, TEMP MANAGER, HR, Operations/Payroll Manager
-I had already been very ill leading up to my leave, and although my partner and I had made some ground restoring my health and wellbeing, my former employer and their HR person completely destroyed any progress I made in the spring. July and August were particularly difficult. My medications were all increased/modified to help me cope with their treatment of me.

ME: When I first went on leave I gave management (and I believe possibly front desk as well) permission to contact me via phone for emergencies and pressing matters. At that time, I also requested all other communication come through email, and that none should come through social media. I had requested this information be passed on. It was not.
The ORGANIZATION and its staff, since I have started this leave, have mistaken my examination dates twice insisting on a meeting for a date that was incorrect, requiring my attention to correct the issue; have revoked my permissions and removed me from ORGANIZATION groups and social media without any explanation, leaving me to think the worst; have reminded me time and again that I am still an employee yet, again, does not communicate when changes are made that appear to me as if I am no longer desired as an employee; and lastly, have demanded my response to non-urgent messages, when the date in question is more than one week away.
Hostility and questions such as, “Perhaps you did not receive TEMP MNGRS email? Similar to when you did not receive my meeting invite?...”, as well as, “She is avoiding meetings with myself and TEMP MNGR and answers communication in a very leisurely pace”… are entirely uncalled for and rude.
I in fact did not receive an agenda of topics, but instead read, “There are some questions I have regarding the portfolio of work you maintained. Unfortunately, these are things which are best discussed via a meeting, considering the back and forth emails would be too onerous and tedious…” and that is all. Perhaps TEMP MNGR intended to attach a file, I do not know. As it has been pointed out above, I miss things.
I already once reminded you I am on a sick leave. Unfortunately, I have to point out that not one of you knows the extent of my health currently, nor of any events that have taken place since that have impacted my health or were a result of my poor health. I will also remind you I am not obligated to share such details. TEMP MNGR mentioned in her email- “I appreciate you’re not well, and I do hope you’re taking this time to do what’s necessary to feel your best.” Such a nice sentiment only has any merit if followed by acceptance of what I and my doctor deem as beneficial to my health. The ORGANIZATION’s inability to communicate their pressing needs without hostility through appropriate means of communication is depressing, and frankly, this entire ordeal has poisoned my opinion and respect for the ORGANIZATION.

I want to point out that I submitted my resignation on August 11 and based on your explanation of pay dates, it appears I should have been paid out on August 19th. It is my understanding that the ESA stipulates that owed vacation pay is due on next pay or 7 days (whichever is later (we’ll say business days)) after employment termination. Seven business days would have been the 22nd, if not paid out on last pay date.
I would like to request a cheque for my remaining 100.19 vacation hours be paid out as soon as possible via cheque. Please email me with an ETA as well as text me when it is ready to be picked up.

As I did not ever agree to increase my donation amount via my paycheque, I would like an explanation as well as a refund of the $500 (minus $2.50 multiplied by 5 for each paystub in question) that was wrongfully deducted from my pay cheques. This story may or may not be fiction, but Arif Ayaz's quirky style provides a way for us to go into the past, and through various events excavate the history of Kashmir. This 'elliptical' way of writing, breaching the boundaries between fact and fiction, works amazingly well for a place like Kashmir where it is the only way of apprehending the consolidation of apparently irreconcilable elements. Arif Ayaz's figurative and literal language, although talking about Kashmir, reads less like a melancholy and more like a comedy, and that may be because the horrors inflicted on Kashmir and its people can be only approached obliquely.
This is a brief and incomplete history of the world-famous Resham restaurant in Srinagar, narrated through three kaleidoscopic events.
It is said that one fine evening in the summer of 1853, nearly seven years after he had bought Kashmir from the British for 75 lakh Nanakshahi rupees; an annual tribute of one horse, twelve shawl goats of approved breed (six male and six female) and three pairs of Cashmere shawls; and one giant stab in the back of the Sikhs at Lahore, who had dared to ask that he return the treasure he had taken with him from the capital city; Gulab Singh, once a Dogra chieftain of Jammu and now the first Maharaja of Jammu and Kashmir, was sitting in the garden of his palace by the banks of the Dal lake, absorbed in the ménage à trois of air, water and the sun. The water looked as mesmerizing as ever, its graceful movement giving nothing away about its age and the depth of its feelings. It gleamed in the ageing day’s last rays, which had more light than heat in them. On the other hand, the young upstart breeze, fresh from the mountains, had a nip in its flight as it created ripple after ripple in the heart of the hopelessly romantic lake. The bigger the ripples, the more the water sparkled in the lukewarm sunlight. A pleasant quiver ran up and down the Maharaja’s body.
His reverie was broken by a guard who informed him that Subhana, a commis chef in the royal kitchen, sought audience with His Majesty. In such fine weather, and below the magnificent Zabarwan, the king was feeling magnanimous, so he ordered the guard to allow Subhana to be brought into his presence
Subhana was ushered in. He bowed and began with the customary salutation, “Long live Maharaj Adhiraj, whose valour is legendary, exceeded only by his mercy. Your Majesty, if life is spared, may your humble servant dare to utter a few words.”
The king’s gaze remained fixed on the ripples in the lake as he made a gesture with his hand, “By all means speak up.”
“Your Majesty, your humble servant feels obliged to inform you about a misdemeanour which has been taking place inside the royal palace.”
The king shifted ever so slightly in his seat and turned to take a look at Subhana for the first time. “What misdemeanour?”
The king’s gaze paralyzed Subhana’s tongue.
“Speak up, peasant! You will be protected and rewarded.”
Goaded by the king’s yell, Subhana bowed his head again and began to report, “Your Majesty, small mouth, big talk, your worthless servant only wants to bring to your notice a theft that is being committed in the royal household, specifically from the royal toilet.”
“What kind of theft? Who steals and what is being stolen?” The king demanded. He was getting a little impatient with all the beating about the bush.
“Your Majesty, silk rolls, used ones, are being stolen from the royal toilet,” Subhana blurted out.
During the days leading up to the first Anglo-Sikh war, unbeknownst to the many brave Sikhs who might have been under the impression that wars were only won on the battlefield, the British and the Dogras had become thick as thieves. This friendship of convenience was edifying for both sides. Behind closed doors, the Dogras taught the wily British, forever hungry for new lessons on warcraft, the subtle art of defeating a state by commanding its armies to doom. The British, in turn, taught the Dogras to wipe their bottoms instead of washing them. Among all the Dogra nobility, Gulab Singh took to the new custom like a duck takes to water, or a librarian takes to paper, if that is more apt.
Once he became the king, Gulab Singh issued a decree that silk be made available for use in the royal toilet. Whenever the king went inside, two men would hold a silk roll on either side of the toilet, one unrolling it for the king’s use and the other rolling it up afterwards. Now Subhana was telling the king that these attendants, after rolling up the silk, were in the habit of carrying it to the lake where they washed the royal excrement off and then took the silk back home or sold it in the marketplace.
The king smiled. The gentle rumbling in his stomach was testament to his satisfaction with the thought that silk embroidered with his poop was so awfully valuable to his subjects. He was also happy with the loyalty of the peasant. Letting out a chuckle, he summoned his Prime Minister.
When the Prime Minister arrived, he was directed to issue a decree to the effect that the estate next to the royal palace, which was part of the royal stables, had been granted in perpetuity to Subhana and his progeny. In addition, the king instructed, Subhana was to receive all the silk from the royal toilet from then onwards. There was no question of Subhana not accepting the dubious honour graciously; the king had a reputation of being ruthless and the prospect of the wealth one could acquire by selling a shitload of silk of the finest quality was irresistible. Kashmiris, who had even then perfected the fine art of name-calling, gave Subhana the nickname Resham and thus was born the Resham cognomen.
During the next hundred years, as Dogra rule flourished in Kashmir, nurtured by their infamous brutality and British indifference, the Reshams rose to prominence and diversified their business portfolio. In addition to becoming world-renowned dealers in silk, they also sold carpets and shawls in lands near and far. But the success of their other ventures did not make them forget their roots. Their primary business remained crafting delicious meals for the rich and powerful.
After the reins of power were passed on from Dogras to Indians, the Reshams began to cater as waaze to the culinary desires of the nobility of democracy—ministers, shadow ministers and other politicians; bankers and businessmen; bureaucrats and police officers; contractors and snoops; and famous lawyers, doctors and journalists; with the occasional poet or writer thrown into the mix as a condiment. The Resham estate, wedged between the mountain and the lake, was a prime location preferred by the wealthy to throw lavish parties under flamboyant marquees.
A few decadent decades later, as the increase in the number of India’s elites outpaced even the explosive growth in population and the first crop of the land reforms ripened in Kashmir, a part of the estate was converted into an eatery to serve what had become a constant flow of patrons. Resham Restaurant and Resort became the three Rs of Srinagar’s cultural landscape. This switchover was not achieved without causing a fair bit of heartburn as the older generation of the Reshams wasn’t too keen on diluting their glorious waaze tradition—where even noblemen had to book in advance and wait for their turn—by entering the restaurant business—where they could not refuse food or services to any hillbilly with a dime in his pocket. But when the brutal counterinsurgency against the armed uprising of 1990 put an abrupt end to open-air shindigs in Kashmir, the transition made by the younger generation of the Resham clan was abundantly validated.
The second incident occurred a couple of years after an insurgent Kashmir had been brought under the military jackboot. During those days, the restaurant was frequented mostly by pro-India politicians, pro-government journalists, and men and women—mostly men—paid by the government to occupy the grey space between being a politician or a journalist and being a civilian.
Over copious amounts of coffee, a senior journalist from India was enjoying his banter with a local police officer. Thick smoke fogged the restaurant, as if the whole establishment, nay the whole valley, was on fire, when, in fact, it was just that every last patron was lighting cigarette after cigarette to becloud the bright autumn afternoon.
“The trouble with you guys,” the journalist was explaining as he shoved another stub into an ashtray, “is your odious notion of exceptionalism. The problems of Kashmir are the problems of every other state in India: Poverty, entrenched elites, lack of development, and a government that treats people like subjects and not as citizens.”
The police officer already had a few kills under his ever-widening belt but still preferred to defend Kashmir and Kashmiris in private conversations. He had justified this apparent contradiction at an encounter site a few weeks earlier to a younger officer who was being blooded that day, “Civility is everything. After all, we are not animals. We are here only to do our jobs; and, sometimes, government work can get dirty. Just like one does unspeakable things with one’s wife in bed but never talks about them, we remain silent about the nature of our work. We maintain civility at all costs.”
Perhaps that line of thought had lingered on as he adjusted the belt on his trousers before replying to the journalist, “But, sir, with due respect, you are forgetting a crucial point. Your argument is like saying sex is sex, and it is the act that matters and nothing else. But consent is everything. If one has sex with someone with their consent, then, even if the sex is painful, it is pleasurable. But when sex is done without consent, it is rape, and the question of pleasure does not arise. The problems that exist in Kashmir may exist in the states of India, it is true, but here the people do not consent to either their creation or their solution by the state. That should amount to something, no?”
The journalist cured the sour look on his face by lighting another cigarette. During his previous visit to Kashmir, his daughter had accompanied him to tick-off the mandatory visit to the “Paradise on Earth” before she flew to England for higher education. Now, he couldn’t believe that she had told him she had found this officer “interesting”. As interesting as idiocy wrapped in bigotry and topped with a generous dollop of chauvinism, no doubt, he said to himself as he took a deep puff on his new cigarette and rejoined, “There is that sense of exceptionalism I was telling you about, my friend. Very rich of you guys to compare your situation to a woman in distress. I have seen how you treat your women. If the militants get what they want, Sharia law will descend like a blight upon this beautiful valley and its gorgeous women. Look across the border, for every Benazir there are a million ba-nazirs. We are your best bet, I am telling you. So consider this: It would be rape only if you people did not consent, which is why you should stop resisting and just offer your consent. That might even win you some goodwill in Delhi.”
The police officer had been a part of the Indian establishment long enough to not be surprised by this tautological defence of rape. Besides, the senior journalist went to school with one of the police’s departmental heads, not the officer’s current department, to be clear, but like death and taxes, transfers were an inevitable fact of life, so the officer reckoned he was better off without ruffling any feathers. Instead, he offered a feeble, tangential rebuttal, “Sir, Sharia itself means law, so saying Sharia law is an exercise in redundancy.”
“Bah! Tell that to the Oxford guys who put it in their dictionary. I am a slave to convention, my friend.”
“And if the convention changes?” the police officer asked; a little too quickly, he worried as soon as he had uttered the question.
Somehow the senior journalist seemed not to have noticed, offering only a guffaw and waving a dismissive hand, which he extended a little in one smooth gesture to order the cheque. He was getting late for another meeting.
There had been some disturbing reports about a brutal torture centre established right next to the Resham estate. The ever-flourishing valley grapevine was abuzz that a part of the torture centre, or interrogation centre, as such places were commonly called in Kashmir, had been carved into the mountainside, and no detainee thrust into the darkness of that cave ever returned to the light of the day. Except that a new rumour doing the rounds was about this one alleged person who had survived the ordeal. This shadow of a man had purportedly seen fingers, toes and other human body parts swept into piles in the corners of the cave, and scribbling in blood on the walls, of course in goddamn nastaliq. Very unsavoury business all around and almost certainly untrue, the senior journalist had presumed. He wanted to get the truth straight from the horse’s mouth, so he was meeting the brigadier in charge of the facility housing the torture centre.
The third and hopefully not the final incident occurred about a quarter of a century later. After being mostly a resort in the first decades of its existence and a restaurant for many decades afterwards, the Resham estate had finally hit the sweet spot between being a restaurant and being a resort. A new clutch of the wealthy had matured in Kashmir, nourished by the blood of thousands and fattened by money from India and Pakistan. In the beginning, an ancient shame hampered them from indulging in ostentatious displays of wealth so close to their blood grounds, and made them fly to Mumbai or Dubai, New Delhi or New York, to organize their out-of-this-world bashes. But rubbing shoulders with the rich and famous of other lands had finally managed to rid their bodies of remorse. Leisurely, they began to stay back and organize their parties in Kashmir once again. Their Indian friends were only too eager; after two decades of disengagement, Kashmir had acquired the charm of an old lover who was good in bed.
Revelry returned to Resham Restaurant and Resort with a vengeance. On one such occasion, a famous hotelier’s daughter was getting married to a minister’s son. The hotelier was an old family friend of the Reshams and they had insisted on hosting the reception because “she was as much a daughter to them as she was to her father”. They had even agreed to forego the traditional traem in favour of a buffet because the bride’s and groom’s friends from India and elsewhere found it unhygienic to share their plate with three other people.
A few of the bride’s friend’s from Delhi and Mumbai were sitting at a table with some local guests, enjoying their meal.
“I mean, I have had waazwaan before, but holy freakin crap, is this goshtaba blowing my mind right now!” gushed one
“Absolutely delish!” proclaimed another.
“I mean, if you can get food like this, I can’t think of a reason you would need to do anything else in life. Like, if I lived here, all I would do is take shikara rides in the Dal all day and return home to this divine food in the evenings,” the first girl continued.
Another guest chimed in, “If there is ambrosia on Earth, it is here, it is here, it...” he stopped abruptly as soon as he noticed that no one was in the mood to ride a hackneyed horse. So he changed track, “Which makes all the senseless violence going on here even more tragic,” he said, looking accusingly at one of the local guests.
The accused guest replied by way of an explanation, “Kashmiris love grief too much. We think it is something to aspire to, to seek out in life. Read our poetry, our epics, our ballads, they are all overflowing with grief and tragedy. Hell, even this waazwaan we are enjoying has its roots in oppression and sadness! And when you accord too much respect to something, it is obviously going to use your head as its throne.”
The mood at the table nosedived.
“I am sorry, what’s the wazwaan story again?” Another wide-eyed guest in a saree enquired.
“Well, it is said that during the Afghan era, when the rulers took more than half the produce as taxes, people did not have enough to eat. Famines and near-famines became common. The Afghan governor of Kashmir had to wade through a sea of locals every day, begging him to lower the taxes. When he grew tired of the never-ending lamentations, he met with a few local representatives and expressed his inability to lower the taxes, because they were set by the court at Kandahar. He promised the deputation that if they came up with a scheme that could provide relief to the people of Kashmir without changing the tax structure, he would act on it. The deputation held deliberations for weeks. People from all over the valley who heard about the ongoing deliberations joined the delegation, because there is nothing Kashmiris enjoy more than planning their future, even when it is not in their hands. Finally, after thirty-six days, someone produced an idea which led to a consensus. The delegation asked the governor to make food eaten at feasts—like weddings and urs—tax-free. He readily agreed. Little did he know that Kashmiris would begin to eat like a pack of ravenous dogs at such feasts, and thus was born waazwaan. It is a surplus of sorrow.”
“That’s so fascinating! How can I know more about it? Has someone written on it? Can you direct me to some sources?” the girl’s eyes were aglow with interest, almost passion.
The local guest turned to look around the table. Most of the Indian guests had left, to join others or to get a fresh helping of food. A couple were paying some attention to his story, largely out of politeness. So his gaze returned to the girl in the saree, “There are some references here and there, but it is mostly oral history, passed down the generations like a recipe.”
“It would make a great PhD dissertation. I would love to work on it. Can you give me your number and we can talk about this later...”
While all this was going on, another guest was struggling with something in his mouth. Finally, he managed to track it down with his tongue and fished it out with his thumb and index finger. He was angry because he hated bones and had been careful to ladle his plate with the boneless stuff from the buffet. Bloody attendants, couldn’t even be trusted with the simple task of separating meat from bone. As he examined it, he realized that it was not a piece of animal bone at all. For one breathless moment, horror grabbed him by the collar as the shape of a human pre-molar manifested itself.
He scanned the room to see if anyone was paying attention, but they were preoccupied with satiating their hunger for food and discourse. So he quickly disappeared the tooth under the table and continued with his meal.
